Summary:
Education; memorializing Congress concerning the Individuals with Disabilities Education Act (IDEA). Expresses the sense of the General Assembly that, in the reauthorization of the Individuals with Disabilities Education Act, Congress should provide disciplinary flexibility to state and local education agencies. This resolution notes the national epidemic of violence and the involvement of children in this violence. The efforts in Virginia to deal with these problems are also noted. This provision recognizes the Commonwealth's statutory responsibility to provide free, appropriate education to students with disabilities; however, the state's belief that rules should apply equally to all is expressed. Virginia has been locked in a legal battle with the federal government for the last several years because of the policy relating to equal application of school conduct codes. Presently, the state is under a hearing officer's order to continue to provide a free and appropriate education to disabled students who have been suspended or expelled, frequently as a result of violent or criminal activities. The suspended or expelled students are, for the most part, being educated at home by school division teachers.
