Summary:
Possession of infectious substances with the intent to injure; damage to facilities. Prohibits the possession of an infectious biological substance capable of causing death with the intent to injure another (Class 5 felony) and provides a penalty (Class 4 felony) for the damage or destruction of facilities which are involved in the manufacture, sale or distribution of such substances where the damage or destruction occurs with the intent to release the substance and thereby injure another.

The bill anticipates the relocation of the world's largest distributor of microorganisms to Virginia. Currently no state laws exist to prohibit the purchase or possession of many infectious substances which can cause mass destruction; for example, anthrax, bubonic plague, and ebola.
