Summary:
Exemption of air and water general permits from APA. Exempts the issuance of general permits by the State Air Pollution Control Board and the State Water Control Board from Article 2 ( 9-6.14:7.1 et seq.) of the Administrative Process Act, provided that the Boards: (i) publish a Notice of Intended Regulatory Action; (ii) form an advisory committee to assist in the general permit development; (iii) accept public comment for at least a 60-day period; and (iv) hold at least one public hearing on the general permit.
