Summary:
Local regulation of sewage sludge. Allows local governments, by ordinance, to regulate the land application and storage of sewage sludge. Localities may not require permits or special exceptions for state permitted sewage sludge applications. Local ordinances may not impose restrictions on the infrequent land application of sewage sludge which are more stringent than the regulations of the Board of Health. Localities may impose setback requirements to minimize impacts on residential areas where sewage sludge is applied without incorporation into the soil and may abate any activity constituting a nuisance or which violates an ordinance or the Board's regulations. Land application of sewage sludge, permitted under the Board of Health's regulations, is deemed to be an authorized use in areas zoned for agriculture or forestal uses and for reclamation of mined lands.
