Animal shooting enclosure. Places responsibility for licensing and regulating the operation of an animal shooting enclosure with the Department of Agriculture and Consumer Services. The Department is authorized to deny, suspend or revoke a license if the (i) applicant does not own or lease the land to be used for the enclosure, (ii) applicant does not meet local zoning and land use requirements, (iii) operation poses a threat to human and animal health, (iv) operation poses a threat or harm to wildlife, agricultural practices or livestock, or (v) enclosure is constructed or maintained in a way animals may escape. Those enclosures which were in operation on or before January 1, 1995, will be allowed to continue operation, provided they (i) only allow the shooting of certain genera of sheep, goats and hogs and (ii) meet the regulatory requirements of the Department. These enclosures will be the only facilities allowed to operate. An operator must pay a one-time application fee and an annual license fee in an amount sufficient to pay for the costs of the regulatory program.
