Summary:
Pharmacies and ancillary service providers; freedom of choice. Modifies the pharmacy provider freedom of choice statutes enacted in the 1994 Session of the General Assembly (HB 840) as follows: (i) individuals may select nonparticipating providers who have notified the insurer, HMO or corporation providing health care subscription contracts of their agreement to accept reimbursement at participating provider rates; (ii) individuals selecting nonparticipating providers may not be charged more than the participating provider reimbursement rate plus copayment; (iii) such insurers, HMOs or corporations may not deny nonparticipating providers access to their electronic claims processing system if such providers agree to execute provider agreements; and (iv) the bill prohibits requiring individuals using nonparticipating providers to make payment at the point of service unless this requirement is similarly imposed on individuals using participating providers. The bill also repeals the ancillary service provider freedom of choice statutes. Finally, the bill exempts from the pharmacy freedom of choice provisions, those pharmacies that are operated exclusively for an HMO.
