Volunteer and charitable organizations. Grants immunity to volunteer employees, directors, officers and trustees of 501 (c)(3) charitable organizations, nonprofit corporations, hospitals and state and local government entities while acting in good faith in the performance of their duties. The liability of these volunteers for injury and damages resulting from the operation of motor-driven equipment is capped at the limits of applicable insurance coverage, if any.

The liability of tax-exempt 501(c)(3) organizations is also capped at the lesser of (i) actual damages or (ii) $300,000 per person and one million dollars per occurrence for injury or death, $100,000 per occurrence for property damage and $100,000 for any other injury. The act applies only to acts or omissions occurring on or after July 1, 1994, and does not apply to intentional, wanton, willful or reckless actions or to health care providers, as defined in the act.
