Informed consent. Requires a 24-hour waiting period after providing a woman with specific information concerning her pregnancy, birth and child care generally, alternatives to abortion, support laws and available assistance. The Department of Health is required to prepare certain of the materials. Certain information regarding her particular pregnancy may be provided over the telephone. If the woman requests the information prepared by the state, it must be furnished to her 24 hours before the procedure or mailed to her at least 72 hours before the procedure. Failure of a physician to provide the information without obtaining the written certification of the woman will be punishable as a Class 4 felony. In addition the physician is subject to treble damage civil liability plus liquidated punitive damages of $10,000 if the abortion is performed or $5,000 if it is attempted.
