Summary:
Class action; settlement of federal retirees claims; etc. Increases the retirement allowance for the various systems by a factor of three percent effective October 1, 1994; eliminates indexing of the deduction for taxpayers ages 62 and older after January 1, 1995; and creates a deduction of $7,600 for taxpayers 65 or older and 3,800 for taxpayers 62 to 64. The bill also provides for a remand to the circuit court of the federal retirees' appeal in Harper for the purpose of identifying all claimants necessary for a full resolution of the matter, allowing claimants to intervene or join in Harper and certifying a class for purposes of entering into a settlement agreement. The bill defines various aspects of the settlement authority of the Attorney General (e.g., no more than $340 million paid out over a five-year period, etc.). Claimants who do not either join the class action for purposes of settlement, join Harper or file an action prior to September 1, 1995, are forever barred from asserting a claim for refund of the taxes paid on the specified retirement benefits. If the total dollar amount of the claims of persons opting out of the class action exceeds $15 million, the settlement authority is void.
