HOUSE BILL NO. 5001
AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the Senate Committee on Privileges and Elections
on April 7, 2011)

A BILL to amend the Code of Virginia by adding a section numbered 24.2-303.3 and by adding in Article 2 of Chapter 3 of Title 24.2 a section numbered 24.2-304.03 and to repeal §§ 24.2-303.1, 24.2-303.2, 24.2-304.01, and 24.2-304.02 of the Code of Virginia, relating to the decennial redistricting mandated by Article II, Section 6 of the Constitution of Virginia.

Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 24.2-303.3 and by adding in Article 2 of Chapter 3 of Title 24.2 a section numbered 24.2-304.03 as follows:

§ 24.2-303.3. Senate districts.

A. There shall be 40 members of the Senate of Virginia elected from 40 senate districts and each district is entitled to representation by one senator.

B. All references in this section to boundaries of counties and cities shall be interpreted to refer to those in existence on April 1, 2011, and as reported by the United States Bureau of the Census in the 2010 Census reports provided pursuant to United States Public Law 94-171, notwithstanding subsequent boundary changes by law, annexation, merger, consolidation, or the voiding of boundary changes theretofore made final.

C. Parts of counties and cities listed in subsection D are defined by reference to the 2010 Census reports for the precincts, parts of precincts, and blocks listed for each senate district in the Statistical Report on file with the Clerk of the House for the Act of Assembly containing the final enactment of this section. Precincts shall be interpreted to refer to those in existence on April 1, 2011, and as reported by the United States Bureau of the Census in the 2010 Census reports provided pursuant to United States Public Law 94-171, notwithstanding subsequent changes made by localities.

D. The 40 senate districts are:

§ 24.2-304.03. House of Delegates districts.

A. There shall be 100 members of the House of Delegates elected from 100 House of Delegates districts and each district is entitled to representation by one delegate.

B. All references in this section to boundaries of counties and cities shall be interpreted to refer to those in existence on April 1, 2011, and as reported by the United States Bureau of the Census in the 2010 Census reports provided pursuant to United States Public Law 94-171, notwithstanding subsequent boundary changes by law, annexation, merger, consolidation, or the voiding of boundary changes theretofore made final.

C. Parts of counties and cities listed in subsection D are defined by reference to the 2010 Census reports for the precincts, parts of precincts, and blocks listed for each House of Delegates district in the Statistical Report on file with the Clerk of the House of Delegates for the Act of Assembly containing the final enactment of this section.
