Summary as passed Senate: (all summaries)
Administration of government; acceptance of foreign personal identification cards; penalty. Requires every agency, political subdivision or court of the Commonwealth to verify the lawful presence in the United States of any person who has made a claim of legal residence or domicile in the Commonwealth for any purpose for which legal residence or domicile is required by law, ordinance, or regulation. Under the bill, a citizen of the United States or an alien who presents a valid identification document that is included on the published list of documents maintained by the Department of Motor Vehicles as proof of lawful presence in the United States is presumed to be lawfully present in the United States. The bill also provides that it shall be a Class 2 misdemeanor for (i) any person to willfully use a personal identification document issued by a foreign government as evidence or proof of legal residence or domicile in the Commonwealth for the purpose of obtaining public benefits, and (ii) any person, other than a citizen of the United States, who does not possess valid documentation of lawful presence in the United States to attest, with the intent of thereby obtaining a public benefit or service for which legal residence or domicile is a requirement, that such person is a legal resident or domiciliary of the Commonwealth. The bill incorporates SB 293.
